These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Emergency Repair Plumbers ("Company," "we," "our," or "us"). These Terms apply to all plumbing services requested, scheduled, or performed by Emergency Repair Plumbers.
1. Acceptance of Terms
By booking a service — whether via our website, by telephone, or in person — you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you are booking on behalf of a business or property owner, you represent that you have the authority to bind that party to these Terms.

2. Scope of Services
Emergency Repair Plumbers provides residential and commercial plumbing services throughout the Greater Toronto Area (GTA), including but not limited to: Toronto, Mississauga, Brampton, Markham, Vaughan, Richmond Hill, Oakville, Scarborough, Etobicoke, and North York.
Our services include emergency plumbing response, drain cleaning, pipe repair and replacement, water heater repair and replacement, toilet repair and replacement, sewer line repair, backwater valve installation, water line repair, faucet and fixture repair, and gas line services.
The precise scope of work to be performed at any service call will be defined in a written estimate provided to you before any non-emergency work commences. By accepting the written estimate, you authorise Emergency Repair Plumbers to proceed with the described work at the agreed price. Any changes to the scope of work during a service call will be communicated to you and require your express approval before additional work is performed.
Emergency Repair Plumbers reserves the right to decline a service request if, in our licensed plumbers' professional judgment, the work requested is outside our scope, unsafe, or would violate applicable building codes or bylaws.
3. Quotes, Pricing & Payments
Written Estimates
For all non-emergency, planned service calls, a written estimate will be provided to the Customer before work begins. The estimate will detail the scope of work, materials required, and the total estimated cost including HST. Estimates are valid for 30 days from the date of issue.
Emergency and After-Hours Rates
Emergency plumbing services dispatched outside of standard business hours (evenings, weekends, and statutory holidays) are subject to emergency call-out and after-hours rates. Typical emergency rates are:
- Call-out fee: approximately $200–$300 (covers dispatch and travel to your location)
- Labour rate: approximately $200–$350 per hour depending on time of day, day of week, and nature of the emergency
- Parts and materials are charged separately at cost plus a handling fee
Our dispatcher will advise you of the applicable rates when you call to book. By proceeding with the booking after being quoted these rates, you agree to pay the applicable emergency pricing.
Payment Terms
Payment is due in full upon completion of the service. We accept the following forms of payment:
- Cash
- Credit card (Visa, Mastercard, American Express)
- Debit card
We do not accept personal cheques for residential service calls.
Taxes
All invoices are subject to Harmonized Sales Tax (HST) at the Ontario rate of 13%. HST is applied to both labour and materials and will be clearly itemised on your invoice. Emergency Repair Plumbers is registered for HST purposes; our HST number is available upon request.
4. Cancellations & Rescheduling
We understand that plans change. Our cancellation policy is as follows:
- Planned service calls: Please provide a minimum of 2 hours' notice prior to your scheduled appointment if you need to cancel or reschedule. Cancellations with at least 2 hours' notice will not incur any cancellation fee. You may reschedule to any available time slot at no charge.
- Late cancellations: Cancellations received with less than 2 hours' notice may be subject to a cancellation fee to cover the plumber's travel time and lost booking.
- Emergency response calls: Once a plumber has been dispatched to your location in response to an emergency call, the emergency call-out fee is non-refundable, regardless of whether work is ultimately performed at the site. This policy reflects the cost already incurred in dispatching and travelling to your location.

5. Warranty
Labour Warranty
Emergency Repair Plumbers warrants all labour performed by our licensed plumbers for a period of one (1) year from the date of service completion. If a defect in workmanship becomes apparent within this warranty period, we will return to your property and repair the defect at no additional labour cost to you.
Parts and Materials Warranty
Parts and materials installed by Emergency Repair Plumbers are covered by the respective manufacturer's warranty. We will assist you in making a warranty claim with the manufacturer where applicable. Manufacturer warranty terms vary by product and are separate from our labour warranty.
Warranty Exclusions
Our labour warranty does not cover defects or failures caused by:
- Misuse, abuse, or improper operation of plumbing fixtures or systems by the Customer or third parties
- Acts of nature, including flooding, earthquakes, extreme weather events, or ground movement
- Modifications to the repaired work by the Customer or any third party not authorised by Emergency Repair Plumbers
- Pre-existing conditions or defects in the property's plumbing infrastructure that were outside the scope of the original service call
- Normal wear and tear
6. Limitation of Liability
To the maximum extent permitted by applicable Ontario law, Emergency Repair Plumbers' total liability to you for any claim arising from or related to a service call shall not exceed the total value of the services rendered in connection with that specific service call.
Emergency Repair Plumbers shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to: loss of use of property, loss of business revenue, cost of temporary accommodation, or water damage caused by pre-existing conditions that were not directly caused by our workmanship.
Emergency Repair Plumbers maintains full commercial general liability insurance and WSIB coverage for all employees. Proof of insurance is available upon request.
Nothing in these Terms shall limit our liability for death or personal injury caused by our negligence, or for any matter where it would be unlawful to limit liability under the Consumer Protection Act, 2002 (Ontario) or other applicable legislation.
7. Intellectual Property
All content on the Emergency Repair Plumbers website — including but not limited to text, images, graphics, logos, icons, service descriptions, blog posts, and the overall website design — is the exclusive property of Emergency Repair Plumbers or its content licensors and is protected by Canadian copyright law and applicable intellectual property legislation.
You may not reproduce, copy, republish, distribute, transmit, display, or create derivative works from any content on our website without our prior written permission. Limited personal, non-commercial use for reference purposes is permitted.
8. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
Any dispute arising from or relating to these Terms, or to any services provided by Emergency Repair Plumbers, shall be subject to the exclusive jurisdiction of the courts of Ontario sitting in the City of Toronto. Both parties consent to this exclusive jurisdiction and waive any objection to the appropriateness of those courts as a venue.
Your rights as a consumer are also protected by the Consumer Protection Act, 2002 (Ontario), including provisions related to unfair practices, internet agreements, and home service contracts. Nothing in these Terms is intended to, or shall operate to, exclude or limit any statutory consumer rights you hold under applicable Ontario or Canadian legislation.
